With the rapid development of society, social health insurance is to protect the quality of medical services of the insured when they receive medical services and meet the need of masses when they are sick. Through the state legislation, social medical health insurance can be obtained some fees from the social insurance institution when the insured is ill. However, due to large numbers of social medical health insurance fraud makes social medical health insurance doesn’t make effect.Social medical insurance anti-fraud is an important way to maintain the healthy operation of the social health insurance fund, and protect right to social security of insurance applicant. However, the social medical insurance anti-fraud in our country has many shortcomings in the legislative, executive and judicial aspects, which seriously endanger the healthy operation of the fund of social health insurance, and result in a huge loss of social health insurance fund. Therefore, the effective legal measures are important methods to protect the healthy operation of social health insurance fund, and maintain the social security rights of insurance applicant.This article mainly use the progressive approach, the study of history method, comparative method, sociology methods and so on. Firstly, this article prescribe the social health insurance fraud and the social health insurance anti-fraud, and list the basic situations of the social medical insurance fraud. Secondly, it summarizes current legislative situations of the social medical insurance anti-fraud, such as England, America and Germany which have much more perfect system and give us more aspiration. Finally, some anti-fraud legislative measures was given according to the current situation in China, special conditions and basic information I have gathered.
