| Concealment is a Confucianism embodiment of human ethics and the humanities in China, which starts from Zhou Dynasty, The western countries "concealment" thought in the early period of ancient Greece prototype."Concealment" in China history existed for thousands of years, and it was not support since the nation was founded. Furthermore, it is not exaggerate to say that abandon Concealment system is a great loss in criminal law system. This paper includes the feasibility of Concealment System. Hope the principle will return to us in a new way, the adjustment of criminal legislation direction, ease the contradiction between family bond and law.Under the overall context of building a harmonious society, it’s feasible and necessary to add concealment system to our country’s criminal law regulations. Furthermore, it is an act of humanization in the trend of criminal law development and a necessity to build a harmonious society. This paper researches on the effect of adding concealment system to our country’s criminal law regulations. Hope concealment system can be added to criminal law regulations, which can be helpful to adjust criminal law regulation direction and ease the contradiction between affection and law.The main contents of this paper are as follows:The first chapter of the text is China’s’concealment’system’s development.The second chapter is the Concealment System legislation situation in foreign countries, from the "concealment" missing problem,"concealment" theoretical basis and social basis and the modern legal value of it into our criminal law norms of necessity.The third chapter of the paper is "Concealment" back into the perfection of the criminal law. The value was discussed from the angle of legal principle, ethics, and society, in order to explore the rationality of long term existence of Concealment System and its evaluation. The conclusion summarizes the whole paper, and called on the return of Concealment System and look forward to the future. |
