Legal Countermeasures On The Protection Of The Blue Carbon

Ocean Carbon Sinks have the most crucial and effective carbon sink capacity including ocean and vegetated coastal habitats which absorb and restore CO2through providing the most important and valuable ecosystem functions. Recently the countries in the world all focus on the discussion of climate change and carbon emission reduction measures. A growing emphasis on the effectiveness of emission reduction of greenery, people ignored the ocean and marine ecosystems for carbon reduction. Due to all kinds of illegal activities such as destruction of forest, industrial pollution, excessive fishing, ecosystem immigration, unsustainable development and so on they are experiencing a steep global decline. The article reviews the role of the ocean carbon stores, and the ocean carbon store facing the difficulties.. Unfortunately the international conventions of climate change have ignored the ocean carbon sinks as far as we are concerned. Moreover Kyoto Protocol also excludes blue carbon sinks from the Clean Development Mechanism. Therefore it is necessary for it to provide with the same transaction or credit line as the green carbon sinks and integrate into the international law of climate change, energy conservation and emission reduction. On the other hand, the relative international law shall apply for the minimum requirement for the Convention on Biological Diversity. In addition it is important to enforce the jurisdiction of ITLOS and add the crime of damage the ocean carbon sinks into the category of universal jurisdiction because of meeting with the coincidence of interests of human beings. Lastly there are three considerable approaches for the Chinese government to protect the blue carbon sinks including remedy for the defect system of legislation, establishment of unified enforcement and carry out the temporary administrative regulation with regard to greenhouse gasses and voluntary emission reduction by the National Development and Reform Commission. Then on this basis, propose appropriate countermeasures for the legal protection of the blue carbon.
