Study Of Clause Of Quality Warranty In Shipbuilding Contracts

Shipbuilding contract involves a huge amount of provisions, the quality of warranty clause which is very important affect throughout the ship construction, delivery, and a certain period of operation. This article differentiates and analyses the pattern of manifestation of quality warranty,then studies how quality of warranty influences the shipbuilding contract in different countries, meanwhile discussed the problems of quality warranty in shipbuilding contract showing up both in theory and practice. This paper has compared terms of shipbuilding contracts and cases in different countries, and then offered a proposal to solve the problems on the basis of practice and regulation.This article divides into six chapters. The first chapter introduces the terms of quality warranty in shipbuilding contracts, and examines the impact of the quality warranty requirements provisions in different countries. The second chapter to the fifth chapter in accordance with the contents of the shipbuilding contract quality warranty provisions were studied:shipbuilding and quality warranty defects in and after delivery of the vessel under the terms of quality warranty, warranty implementation and cost-sharing, third-party issues. Found that the theory and practice of shipbuilding quality warranty issues under the terms of the contract and trying to find ways to solve problems. Chapter VI of the shipbuilding contract for a number of standard forms of suggestions to improve the quality warranty and for builder and buyer to ensure that their interests in terms of quality warranty not to be infringed, the rights can be exercised.Different standard forms may have completely different regulations towards a same question. In all, it shall interpret and apply the contract combining with the specific environment, take measures according to different situation to ensure the fulfillment of the contractual intention.
