A Study On Legal Responsibility For Food Safety Supervision Administration

At present, Chinese food safety accidents repeated, although the Government has stepped up efforts to punish it, the results are still not very clear. This article is in the process of "Food Safety Law (Revised Draft)" deliberation and the reform of ministry system, mainly in the study of food safety supervision. In the field of administrative law, by administrative liability theory, exploring the meaning of administrative liability in the field of food safety regulation, investigated by studying the administrative status of legal liability, to reflect its presence in the existing system-level issues, combined with the actual food safety supervision, put forward perfect views, the purpose is to promote food security administration legal accountability by improving the administrative efficiency of the legal liability system in order to find a new breakthrough to solve the phenomenon of repeated food safety in China.The first chapter discusses food safety administrative liability theory foundation. Firstly, discuss the concept of food safety regulation. Secondly, discuss the rule of food safety. Lastly, for the perspective of food safety, discuss the theory of administrative liability.The second chapter discusses the status of food safety supervision administration of legal liability, introduced Chinese food safety supervision status, legal status of administrative accountability, analyzed the reasons that lacking of supervision is inadequate accountability mechanisms of administrative law,summed up the issue of food safety supervision administration legal responsibility.The third chapter focuses on the Americans, Europeans, Japanese food safety regulatory legislation, the status and accountability cases, by understanding the regulation of food abroad and to find a suitable Chinese roads.The fourth chapter discusses the improvement of food safety supervision administration legal accountability mechanism is the key to solving the problem of food security, putting forward the specific ideas and refining the accountability mechanisms.Dissertation conclusion, this paper mainly analyzes the basic reason of administrative liability for food safety supervision, draw a conclution that food safety supervision administrative mechanisms is the key to solve the food safety problem, I believe that the accountability mechanisms will play a deterrent role.
