"Inheritance law" since the implementation of the existing more than20years, but the inheritance law in our country hasn’t revised, as an important part of the testamentary succession also did not have improved as time progress, so in the2012symposium of marital inheritance law in China husband and wife together will become a hot topic. Couple will as the special form of the will, the law has an irreplaceable role in the society, it not only adapt to our country’s current national conditions and historical traditions, but also for family stability, the exercise of the rights of citizens also have safeguard function, it is very necessary to establish the in our country. This article from the concept of joint wills, to couple the theory at home and abroad and the differences of the will, listen to various aspects in and under view and analyzing its rationality, necessity and puts forward constructive Suggestions for husband and wife together will build in China, in order to perfect our country related theory. In the article structure in this paper is divided into four parts.The first part of the article is discussed, and the nature of husband and wife together will make this section through the couple will analysis the concept, characteristics, nature, for the following specific advice to lay the theoretical foundation. The second part mainly studies the legislative status quo at home and abroad, mainly to take the essence to the dregs, the model for the construction of the couple’s will in China.
