Since the sixties of the twenties century, the majoritydeveloped countries such as America, Britain, France, Germany, Japan and Canada hasreformed their own traditional adult guardianship system, formed a modernized adultguardianship system constituted by plenary guardianship, intended guardianship andassisted guardianship.Until to nineties of the twenties century, our country has made some generalizedstipulations concerning adult guardianship system in Principle of Civil Law of the people’sRepublic of China and its judicial interpretation issued by the supreme people’s court. It isbeing criticized a lot because of its deterrence in legislative ideal and defects of contentsand procedures concerning adult guardianship system. And it can’t satisfy the diversifiedneed of Chinese potential wards.From the perspective of comparative study, this essay searches into plenaryguardianship, intended guardianship and assisted guardianship consequently and makessome sublation on the three systems, and finally offer a framework of our country’s adultguardianship system integrating with the native reality and relevant legal stipulations ofour country.
