The Liberalistic Procedural Mode And Its Enlightenment Of The Civil Litigation System Of China

Liberalism has been the mainstream ideology of several centuries of the Westernsociety. The individual freedom is the core of liberalism. Basing on the individual freedom,it came into being the liberalistic procedural mode. The liberalistic procedural mode playeda pivotal role in the entire process of the legal system. In this article, I start from theliberalism and procedural mode, then to describe the origin of the liberalistic proceduralmode, and its reflect in the development of specific systems. After that I analyze theadvantages and limitations of liberalism and the liberalistic procedural mode. I focus on thecharacteristics of the liberalistic procedural mode and its combination with the currentsystem of China’s civil litigation system. I select the advantages of the liberalisticprocedural mode, which can be absorbed by the idea of integration into our current systemof civil, and then I summed up the view of the mode and the enlightenment of the civillitigation system.
