Flourishing of Film industry enrich people’s leisure life, but also brought new challenges on the protection of intellectual property. With the increasing number of disputes Title, whether protect names of works, how to protect names of works has became a research topic of intellectual property. Unfair competition disputes of "lost on journey" versus "lost in Thailand."which Occurred in the2013has drawn attention in the film and television industry and legal profession.This paper discusses the following proposition:The name of works as an intellectual achievement. It is not protected by the copyright law context.The Civil Law, Trademark Law, and Unfair Competition Law Protection are also flawed. Depend on MPAA will name of movie as a protection method for exclusive use, the paper proposes the copyright collective management organization call the copyright owners strengthen self-discipline,and protect the name of works by agreement. Moreover I proposed concrete measures and the system.The text is divided into three chapters.The first chapter introduces the merits of a case of "lost on journey"versus "lost in Thailand." Secondly, I proposed contentious issues raised by the case:whether name of the work should be protected? How be it should protected?The second chapter firstly analyzes the concept of name of the work and necessity of interests protected by Title. I discuss asvantages and disadvantages which the current theory of intellectual property rights by the "Civil Law","Copyright Law,""Trademark Law" and "anti-unfair Competition Law " to prevent title infringement. Secondly, I analysis the legal protection of Title thought comparative method.The third chapter discusses the pros and cons which the American Film Institute will name of movie as exclusive use protection. I proposed copyright collective management organization shall call the copyright owners protect their rights, and construct legislation of the public to protect their rights and promote plots.
