Research On Transferring System Of China’s Rural Land Use Right Transferring System

As the most significant traditional industry, land and agricultural issues have beenconcerned with the basic livelihoods of peasants continuously in our country. Rural land useright transferring system is the key to the optimal allocation of agricultural land resources. Atpresent, the mode of rural land use right transferring system is still backward relatively, due tolack of transfer agency and information platform, the mode still mainly involves subcontract,lease and other traditional methods confined inside the rural collective economic organizations,so the old peasant-led "point to point" mode is still preferred. Improvement of the rural land userights transfer mode is an urgent need to develop new socialist modernization in the ruraleconomy. It offers benefits to the promotion of the development of new intensified agriculture,and to the further safeguard of the stability of the new countryside. Rural land use rights transfermode reform is crucial to the development of new urbanization. The Third Plenary Session ofthe18th Central Committee of the Communist Party of China proposed, at its close onNovember12,2013, that the farmers should be encouraged to participate in the modernizationprocess, to share the fruits of modern, urban and rural integration. The construction of newagricultural management system need to be accelerated, farmers should be given more propertyrights, and the development of urbanization system need to be advanced in a healthy way. Thedecision to improve the rural land property rights system in China has laid a foundation forpolicy for the development of China’s rural land use right model provides a new space.Therefore, the perspective of new urbanization from which existing legal issues related to rurallanduserightstransfermodeareexaminedhastheneweraofsignificance.This article devotes to research present situation of rural land use right transferring systembased on the deeply analysis on developing history of rural land use right and indicatessuggestions about building and completing land use right transferring system by figuring outproblems through the research, finding methods for the improvement of the rural land use rightstransfer mode, and trying to promote the construction of new urbanization circulation patterns through reforms to achieve long-term goal of common prosperity and even the integration ofurbanand ruralsociety.In this paper, the innovative perspective would be the perspective of new urbanization andthe innovative content lies in the intensified agricultural development. The paper attempts tochange the old "point-to-point" model under the current market economic system in China, toestablish the new divergent “point to polygon” model in the country, to set up a market and aplatform for land purchasing and storage institutions, and to build up a unified flow tradingcenter, in hope of facilitating a smooth transfer of rural land contract management rights,maximizing the effectiveness of land resources, and promoting the modernization of intensifiedagriculture.
