Criminal record generally refers to a legal state by previously conviction to perpetrator. The elimination of criminal record is a criminal system which reconverts the perpetrator normal legal status by eliminating the legal facts. The existence of criminal record limits the rights and interests of juveniles in all directions, sticking criminal labels on juveniles brings a lot of adverse effects of living for them. In the world trend of ensuring human rights and paying attention to the protection of minors, the existence of criminal record inconsistent with the spirits of the times. From the view of foreign legislative provisions, many states’ laws of foreign countries have directly stipulated the system of the elimination of criminal record from juvenile delinquency, so our country should also build the system.The thesis will start from basic problems of the system of elimination of criminal record from juvenile delinquency to firstly discuss the basic concept of criminal record, and analysis domestic and international perspectives. The thesis will further discuss the concept of elimination of criminal record and define the connotations of the elimination of criminal record from juvenile delinquency. Then the thesis will expound the necessity of establishing this system from two aspects which are the adverse effects of criminal record for juveniles and reality requirement of eliminating criminal record, and then adequately analysis the practicability of this system, based on the research of beneficial foreign experience, local practice and current legislative status. The thesis will finally card the basic thinking of the elimination of criminal record from juvenile delinquency in detail from the aspects of related ideas, legislation, administration, justice, society. On the condition of explicating these problems above, this thesis will analysis construction approach and detailed design of this system on its scope of application, applicants, inspection time, essential requirements, follow-up effects, procedure, thereby I can definite the integral structure and legal system of the system of the elimination of criminal record from juvenile delinquency.
