Victim Commitments

The victim’s consent, refers to the legal subject’s tolerance for others’ violations oftheir legitimately disposable interests in some particular aspects. As a ground forelimination of illegality, the victim’s consent has recently been acknowledged bynumerous countries, and some even have taken it into their criminal codes. Under theinfluence of China’s nationalist thoughts, the researches about the victim’s consent aremerely in the primary stage. However, with the development of China’s society, it is aninexorable trend that the victim’s consent will be legislated during the development oflegal system. According to the overview of the victim’s consent and the commonproblems emerging in the process of judicial practice, this dissertation will mainly focuson the basic effective factors that guarantee the validness and effectiveness of thevictim’s consent as well as its effects on the criminal liability so as to present theconception of the victim’s consent in China based on the domestic actuality and somerelative legislation experience abroad.
