Civil Exclusionary Rule

Today, the concept of human rights protection and procedural justice has long beenpopular, civil action by the exclusionary rule jurists increasingly concerns theapplication of this rule in the judicial activities are also facing a lot of problems to besolved. The main purpose of the establishment of civil exclusionary rule is to denyillegal evidence by way of the ability to protect the legitimate interests of the parties andthe maintenance of the dignity of law. Although there are regulations prohibiting illegalaccess to the evidence on our laws, but excluding illegally obtained evidence in civilprovisions still not perfect. This article first theoretical basis for illegal evidenceexclusion rules are described, and analyzes the necessity and value of the underlyingreality of the establishment of the exclusionary rule; secondly explains the currentsituation of civil exclusionary rule; Finally, in our civil perfect rule excluding illegallyobtained evidence put forward some ideas and suggestions.
