The Research Of Collective Contract Legal Effect

With the development of society, the effect of the collective contract system is also being highlighted. As an important consultation legal system of labor relations, Collective contract is in accordance with the labor standards Law, and guide and restrict the Conclusion and performance of labor contract. According to their actual effectiveness, Major Western developed countries has different requirements, and our legislation give labor unions to represent all employees to sign collective contracts. However, due to China’s labor law and the labor contract law were not be clearly defined to the responsibility of the collective contract,and both employers and employees is easy to confuse the relationship between the general labor contracts and collective contracts, leading to the current practice continued disputes.In this paper, the collective contract practice is the main line, and analysis its problems and the reason, and then learn from foreign experience in legislation, propose some recommendations to resolve disputes.
