Study On The Causes And Countermeasures Of City Noise Pollution

With the development of urbanization, people have high demand for living environment. But the variety of the resulting pollution also increased. A great challenge to the normal life is new pollution to human beings. In recent years, noise pollution and air pollution, water pollution and solid waste pollution is considered together with the society’s four big pollution does great harm to human development. A scientific research shows that individual lives in a long time in the noise environment, suffering mental and physical damage over time, and ultimately to the human body caused by the serious consequences. Therefore, research on the urban noise pollution has very important significance.This paper is divided into five parts, the sources of noise pollution are introduced as the breakthrough point, and the introduction part introduces the topic background and the research status at home and abroad.The second part describes the concept of noise pollution, source and classification. Urban noise pollution there is four major categories, namely the urban road traffic noise, construction noise, industrial noise and social life noise. On the four types of noise to the related research work, analysis and summary of the sources of pollution, once again stressed the harm.The third part mainly introduces the current problems in our country is facing the prevention and control of noise pollution. March 1,1997 "people’s Republic of China environmental noise pollution prevention law", to solve the noise pollution of punishment and the related problems have a legal basis. However, due to "environmental noise pollution prevention law" operability is poor, so there are legal provisions have their defects, according to law enforcement is not perfect; the rights the main rights difficult, difficult, difficult to collect evidence for the definition of administrative levels; restriction, the environmental protection department independence and authority of the administrative main body is not enough etc.. All these problems may lead to "noise pollution prevention and control law" is not well implemented, so that China’s current urban noise pollution remains serious.The fourth part mainly introduces the noise control legislation of developed countries（regions） such as the present provisions relating to noise pollution in the United States, Japan and China’s Hong Kong and Macao regions and research, a more systematic analysis of the extraterritorial related measures taken.The fifth part based on the experience of other countries or government organization, proposed the establishment of the legal system of the prevention and control of noise pollution and improvement measures, specifically reflected in the lack of perfect administrative law enforcement, environmental protection departments to give more power to the law enforcement work, refine, strengthen law enforcement efforts; to establish a diversified dispute settlement mechanism of the noise from the civil law. To the administrative law to criminal law and other department law and environmental law together, to find a reasonable standard to solve the disputes between the procedural law to the substantive law, the rights of the main cost in the process of rights, improve the efficiency of administrative rights; from the set of optimal allocation of administrative decisions and administrative reconsideration system will introduce noise pollution prevention and control work; puts forward the solutions to strengthen the public participation mechanism, trying to solve the problem of noise pollution in cities of China.
