Empirical Research On Litigation Rights Guarantee Problem Of Criminal Victims

Along with the international human rights campaign launched extensively, strengtheningthe protection of human rights of the criminal procedure became the various countries’common focus of concern, especially in November1985the United Nations pass the firstvictim of the important statement about problems, named for crimes and abuse of powerbehavior has the basic principles of justice victims declaration, it marked the victim problemsat the international level was widely concerned. The criminal procedure law of our countrypays more attention to the victim than before, clearing the victim of the status at the sametime, gives its rich litigation rights, but the victim with international litigation rightsprotection in China the victim litigation rights of the security level is not enough, there arestill some loopholes and the gap, therefore, perfect the victim litigation rights guaranteemechanism, and do our best to comfort the victim for crimes of became the most by trauma.This paper, from the criminal litigation rights of the paper, through the investigation ofcriminal victims of the international convention on the related regulations, to the criminalprocedure law of our country to the victim of the litigation rights legislation as the foundation,with China’s national conditions and the need of justice practice, finds out the our countrypresent stage in criminal victims litigation rights protection deficiency.
