Commenting The Criminal Reconciliation In The Point Of Public Prosecution Of China

Since1970s,＂How to protect the benefit of the victims and make the criminals back tocommunity in penal-judiciary system way＂＂was discussed as an important issue. In thisdiscussion western countries raised an idea named” criminal reconciliation＂. Till2000s,Criminal Reconciliation was involved in our country, especially these days it becomes moreand more popular. According the background of "Harmonious Society", all about itsadvantages are more important: recover the society relationships, remedy the victims, restorethe relationships between victims and criminal and finally make the criminals back to regularlife, which makes the society more harmonious. As the resource of judiciary becomesprecious and the case becomes more, it is a reasonable solution to discuss criminalreconciliation’s consciousness of efficiency.Being the centre of criminal theory, studies were held for times. Professor ChenGuangzhong led <Experts’ Advise and Argumentation of Criminal Procedure Law ofAdjustment of P.R.China>, He defined Criminal Reconciliation as a basic rule in CriminalProcedure Law. In the mean time, all around the county begins the exploration, some ofprovinces including Beijing Shanghai Hebei Hunan Jiangsu Liaoning Zhejiang Anhui triedhard. It called a big good reaction. March14th2012, China announced Criminal ProcedureLaw(fixed) which established the process of public prosecution case.As a result, the author included criminal reconciliation’s whole course and analysised thepossibility in China Criminal Procedure Law system. The author considered CriminalProcedure Law(fixed) and prosecutors and made confines, models and programs hoping tofind some help in completing our law system.
