| As the development of international multimodal transport and complicated specialization of work, non-vessel operating common carrier (NOVCC) becomes important component of international carriage of goods by sea. Regulations of the People’s Republic of China on International Ocean Shipping (hereinafter referred to international ocean shipping regulations) issued by the state council department of transportation on December11,2001established the system of NOVCC. Founded on June8,2001, China Association of Shipping Agencies&Non-Vessel-Operating Common Carriers (CASA) means NOVCC is under the double supervision of government and industry organization in China.NOVCC has got great progress for the ten years, but it also exist huge risk. And liability insurance is a more reasonable choice than other risk control measures. However, NOVCC liability insurance system in China is in a fledging period, therefore, studying the system of NOVCC liability insurance has played an important role on promoting the development of ocean shipping industry.Chapter one is the overview of the NOVCC liability insurance, it starts with the definition of NOCCC, and discusses NOVCC legal status and responsibility.Combining with the content of clause of NOVCC liability insurance, chapter two mainly introduces the international market of NOVCC liability insurance, which introduces the development mode of NOVCC liability insurance in EU、America and Hong Kong, in order to provide practice experience for China.By means of comparing China NOVCC bonds with NOVCC liability insurance, chapter three is about the system of China NOVCC liability.Chapter four is about the construction of China NOVCC liability insurance, analyzing the necessity and feasibility of this system, putting forward the ideas of, and drawing out the suggestions. |
