The Characteristic And The Copyright Ownership Of The Movie Works

Movie is a product of a certain stage of development of science andtechnology. Some international convention copyright and most countries take themovie works as the object of the copyright law. As a complex legal object, movie isnot it’s script, but a film that has been shot to finish, Because it is a comprehensive art,collective, scientific and technology, and assignment. One of the most distinctive thanthe film copyright belongs to the movie producer. In this case, what is the legalrelationship between movies and other works, and the copyright law how to balancethe interests between producers and movie?On this basis, I have some opinions that the current copyright law existslacking of legal provisions and ambiguity on some questions, such as unclear of therelationship between the movie works and original works, short of the original authorrights, without adequate protection for directors, screenwriters, composers and author.It is not true that the definition of movie use the method of technology. Definition andownership plays an important role which can be used in handing disputes. Of course,our copyright law need a further improvement whatever in the theoretical study and inthe trial practice. Finally this paper put forward the existing problems for referenceaccording to the demonstration research front. This paper is composed of our parts.Part1. The definition of movie works. The paper try to study what the movieis, according to the definition, properties and the difference between movie works andvideotape. The properties of the movie works is a foundation of the theory and can beused in the later discussing.Part2&Part3The relationship between the movie works and the originalwork and the relationship between the authors and film producers would be discussedin my paper. Mainly analyzes several legislations, as well as the relationship betweenmovie works in the copyright law and the original works.Part4. Talk about the basis of the philosophical value of intellectual propertylaw, comparing the provisions of several countries’ law and the most important one isour mainland.
