As one of the four ancient civilizations, the Chinese nation has always paidspecial attention to the ethical concepts.It has a very important influence for familyharmony and social harmony.After thousands of years of sedimentation,Ethicalconcepts has penetrated into people’s hearts.It has become an important part ofpeople’s values.With ethical values to guide law allows people to recognize and abideby the law spontaneously.Criminal Procedure Law of foreign country and China’s Hong Kong, Macao andTaiwan regions are specified the right to Testify from witness.China’s currentCriminal Procedure Law have no relevant provision about the right to Testify forwitness. In order to better protect human rights, to maintain family, social stability andharmony, building the privilege to Testify for witness is a wise measure to ourcountry’s Criminal suit. The first chapter starts with the affect that ethical to the law.Proving the necessity of ethics to guide the criminal proceedings. The second chapterillustrates the ethical values of witness from Testifying.This lays the groundwork forthe argument that built the Witness Testifying in line with China’s national conditionsaccording to the guiding of ethics.The third chapter describes the privilege of Witnessfrom Testifying of foreign countries and China’s Hong Kong, Macao and Taiwanregions. on the basis of the first three chapters,Chapter IV conducts and summarizesfurther more and put forward the specific ideas of building our system of witness fromtestifying.To further improve China’s Criminal Procedure, and promote the process ofcriminal proceedings.
