The Investment Treatment Issue In BIT

Currently，international investment activities increasing, overseas investmentplay a pivotal role in the development of international economic. So how to deal withthe legal relationship between overseas investors and host country, and therelationship between foreign private investor is one of significant issues ofinternational investment law. However, there isn’t a unified international treaty inworldwide that regulates the behavior of countries and overseas investors, so bilateralinvestment treaty which in order to protect private investors has a important role.Thus, the investment treatment issue which is the key issues of bilateral investmenttreaty requires in-depth study and exploration.The thesis includes three parts: the outline of investment treatment in BIT, thecontent of kinds of BIT model and the analysis of investment treatment in ChineseBIT. Based on research of content of investment treatment in BIT, and draw U.S. BITmodel and German BIT model, the thesis analyzes the problems of investmenttreatment in Chinese BIT and the cause created problems in order to seek methods toperfect our investment treatment system in BIT. The thesis holds China shouldestablish our BIT model with Chinese characteristics and relax moderately ourpolicies of investment treatment to adapt to new international investment environmentand meet the need of protection of domestic investors.
