This paper starts with Tencent and360cases and uses the research network actsof unfair competition in business defamation legal regulation as a main body. We willanalyze the characteristics of defamation and consider the actual situation of China’sAnti-Unfair Competition. By learning from the unfair competition from abroadnetwork business defamation advanced experience and practice, we will try tosummarize the behavior of the network of unfair business competition and givesuggestions and comments to the regulation of these actions.This paper is divided into five parts. Firstly, Tencent and360war merits profileand the results are introduced to the referee, leads to unfair competition in the networkbusiness slander. The second part analyzes the characteristics of competitionrelationship and unfair competition, and network limitations to freedom of expressionand protection. The third part, from our current unfair competition law and relatedlaws and regulations supporting.In the fourth part, with the advanced practiceinductive analysis, we will put forward a sound network of unfair competition inbusiness defamation regulatory proposals.In the conclusion, we will summarize the points of this paper. With the analysisof the Anti-Unfair Competition in network behavior defamation, this paper notes thatn order to ensure the sound development of the network economy, we need to learnfrom the foreign legislative experience which have more advanced legislation andmore mature network.
