The International financial derivative trade is adapting the development of outsociety since the beginning to present. Nowadays, The International financialderivative trade won a place in the present financial market and occupied anirreplaceable status. Compared to floor trade, over-the-counter(OCT)derivatives tradefeatured with characteristics of convenience, expertness and quickness. OCTderivatives financial trade become popular among numerous trading subjects.Meanwhile, the development and scale of OCT derivatives trade far surpasses floortrading. However, the risk of OCT financial derivative trade has increasing been asource of controversy during its fasting growing scale. Associated with legal issues ofthe international financial trade, the utmost important credit guarantee system is thecore of the financial derivative trade.Compared to that of such developed countries as Britain and US, the financialderivative trade system of our country is still much dropped behind, so does theimmature domestic trade market.At present, there is no a specific law to regulate theinternational financial derivative trade, which has lead to a difficult condition of ourmarker. In order to improve credit guarantee system of our country’s OCT derivativestrade market, the following article is mainly applying historical analysis method andcomparative analysis method to introduce the establishment of International financialderivative trade credit guarantee system. To analysis the credit guarantee systemamong OCT derivatives financial trade cases from Britain, US and German, anddiscuss the associated legal issues, to build and improve China’s domestic creditguarantee system of OCT derivatives financial trade.
