Civil Law Protection On Voice Right

With the rapid development of modern science and technology, the techniques ofpreservation, dissemination, replication and cloning of voice are also constantlyimproving. The extent of voice is getting larger and larger. The voice has beendeveloped by a mere communication tools into a commercialization of personalityidentification. The normal use of voice and the protection of their legitimate rightshave become urgent problems and goals in our modern society which is ruled by law.However, when we enjoy our colorful life, our voice interests are facing increasingprejudice raised by parody, commercials and trickiness in entertainment program.This paper intends to start with the analysis of the concept and characteristic ofvoice right, I can reach the conclusion that voice right has dual properties: spiritualproperty and property attributes, but its basic property is spiritual property. Voiceright is peculiar to our nature. Then, with the method of value research andcomparative study, I use the facts legitimacy and legal legitimacy to demonstrate thatvoice right need the independent protection by law. From the factual level, the uniquevoice is more attractive to consumers; this adds brand value to the voice in businessactivities. However, it also increases the possibility of voice infringement. In the legalaspects, I use some theory of legal methodology to compare the difference betweenthe voice right and concrete personality, general personality, copyright and trademarkright. According to these, it proves that voice right could not be covered by theseother rights, and these rights could not totally protect the voice right. At last, I refer tothe protection of voice right relating to some other countries or regions, and learnsomething that is suit for China’s Civil law. It puts forward the scope of protection ofthe voice right is the voice with a significant mark of our nature. The main protectionincludes personal right protection and tort law protection.
