Study On Dong Bi Wu’s Legal Thoughts

This thesis elaborates the historical forming process of Dong Bi Wu’s legal thoughts and the specific content in different periods, analyzes the influences of his legal thoughts in different periods on the historical periods at that time, finally, elaborates his reference value of his legal thoughts for today’s society. The thoughts of Marxist Jurisprudence and Chinese traditional legal thoughts are the base of Dong Bi Wu’s legal thoughts, he combined these thoughts and the actual facts of that time well and formed his own unique legal thoughts.New-Democratic Revolution Period is the embryonic period and forming period of Dong Bi Wu’s legal thoughts. This period mainly includes civil revolutionary war period, the Anti-Japanese War period and Liberation War period. Among them, during the civil revolutionary war period, Dong Bi Wu’s legal thoughts are: legislation is the powerful security of the development of the revolution, law enforcement is an important guarantee means for the purity of the revolutionary ranks, the law is only basis of revolution work; Dong Bi Wu’s legal thoughts during the Anti-Japanese War period are: the main power for people’s thought; the strict law enforcement idea; Dong Bi Wu’s legal thoughts during Liberation War period include: the law is the protection for the interests of the masses; the law is basis for the running of the government; and the law is the mean to consolidate the new-born regime.Socialist period is the maturing period and developing period of Dong Bi Wu’s legal thoughts, Dong Bi Wu’s legal thoughts during this period mainly include: the democratic construction thought, the thought of people’s justice and the thought of “work in accordance with the law”. Among them, the democratic construction thought includes that the people’s Congress system is the main form of the democratic construction, we must deal with the relationship between the Communist Party and the state political power well; the thought of people’s justice includes the people’s justice is the powerful weapon to consolidate the people’s democratic dictatorship country, the aim of the people’s Justice is to protect the interests of the masses, the key of the people’s Justice is to strengthen the cultivation of the judicial personnel; the thought of “work in accordance with the law” includes the thoughts: there must be laws to go by and laws to be observed strictly. Dong Bi Wu’s legal thoughts have the consequent value. Many of his thoughts still have the reference value to today’s society, among them, the thought “work in accordance with the law” has established good base for the proposal of the Strategy of Ruling the Country in Accordance with the Law; the leadership of legislative affairs must be conducted under the leadership of the Communist Party of China; must carry out the legislative work scientifically; must further reinforce the force of judicial reform, to ensure the judicial justice; to promote the administration according to law, build the government governed by law; must strengthen the training for the legal awareness of the cadres and the citizen and so on. We will carry forward the legal thoughts of Dong Bi Wu.
