Along with economic development, the enthusiasm of people to participate insports activities become higher.Sports turn into an integral part of people’s dailylives. Due to the observability of competitive sports, more and more people involvein it.Sports commercialization operations brought greater risks to competitive sportssince commercial operators try to attract more viewers to get more economicbenefits through increasing competitive and skills of competitive sports.In competitive sports, civil rights and interests of participants often suffer at theoccurrence of damage, trespasser’s bearing responsibility of the damage have greatsignificance to both sufferer and development of sports. Due to the fact that injury incompetitive sports differ from average tortuous act, difficulties emerge inidentification of the responsibility and advocacy of the rights safeguarding.This paper would shed light on legal dispute causing human body injury, bydiscussion on the following area: tort liability, exemptions and constitutiverequirements.The paper will cover the following areas:The first part is to defined the related concept on human body injury by givingdefinition of competitive sports, type of human body injury caused by competitivesports, and differences between human body injury in competitive sports and generaltortuous acts.The second part is to analyze the principle and liability of human body injurycaused by competitive sports. With the beginning of analyzing the imputation system,then the paper discuss about application of the concept of fault liability principle,scope of application, as well as matters and cases needs attention.The third part is to analyze the constitutive elements of human body injury caused by competitive sports.As a result, these characteristics of the constituentelements would be applied in determining whether infringement happen.The fourth part discusses liability of human body injury caused by competitivesports. Through statutory and non-statutory point of view, exemptions could bedefined and determined.The last part is to supply recommendations for our current present and futurelegislation establishment.
