Research On China’s Anti-monopoly Law Enforcement Mechanism

Market economy is good and orderly operation needs good competitive environment, itis the inherent requirement of the market economy, but also the precondition of theharmonious society construction. In order to create and maintain a good competitiveenvironment, to the United States as the forerunner, many countries in the world are theintroduction of anti-monopoly law, and through the anti-monopoly law to regulate the marketstructure and market behavior, practice has proved that the anti-monopoly100years, plays aunique role in economic development of anti-monopoly law, and to the full play this role, toachieve the desired objectives, not only need an anti-monopoly law, but also the need for a setof perfect, effective implementation system. This paper is to study the implementationmechanism of anti-monopoly law in our country as the subject, the implementationmechanism of anti-monopoly system to make specific study, combined with foreign, existingin China’s anti-monopoly law existing problems, and put forward suggestions, in the hope ofthe antimonopoly law of our country further contribution. The full text is divided into fourparts, the main contents of each part are as follows:The first part introduces the basic theory of antitrust law enforcement mechanism, clarifythe concept and characteristics of the anti-monopoly law in theory, so as to facilitate theimplementation mechanism of anti-monopoly law is more familiar, and to further explore theoperation principle of the antitrust enforcement mechanism, expounds the positive influenceof antitrust enforcement mechanism on the current economy, pointed out that theimplementation of anti-monopoly positive impact on economic development and the inherentmechanism of necessity.The second part expounds and compares the current situation of the United States andGermany, the implementation mechanism of anti-monopoly law and Its Enlightenment toChina, mainly the United States antitrust law enforcement mechanism, and the mechanism ofhow the operation and implementation of provisions of Germany, and implementationmechanism in the antimonopoly law, is enormous to China’s anti-monopoly implementationenlightenment. The author found in the comparison countries, countries according to thepresent situation of their different conditions of economic development and domesticeconomic operation, put forward in line with the actual situation in the country system, it ishelpful for us to learn the actual situation in foreign countries. Third main problems of part of the main analysis of the status quo of China’santi-monopoly law enforcement mechanisms and existing, focus on the analysis of China’santi-monopoly law enforcement system, judicial relief situation and responsibility system andthe existing main problems.The fourth part the author in reference to the outstanding achievements of relevantcountries, combined with China’s specific national conditions and the problems of theeconomic development, the suggestions on the implementation of China’s anti-monopoly lawputs forward, the hope for our country in the aspect of antitrust enforcement mechanism andprovides the beneficial reference. This reference is proposed, under the specific nationalconditions and the reality of the economic environment, must be practical and localcombined.
