The Study On The Contradiction Between Supply And Demand In Chinese Judicial Remedy Of The Right To Social Security And Related System

Since China’s reform and the development of economy,the society has been changingquietly. The Chinese society has entered a period that is called Contradictions and Eventswhen the reform is carrying on. The reform of the system of social security is not only thesocial security right and democracy and the legal system construction is not only the mostimportant step of the overall reform, but also the guarantee of the transition of the productionmode.In1984, China began to reform the social security system and made a huge progress inthe construction of social security system in the past30years.On the one hand, the reformmake people to accept the idea of the priority position of efficiency and personalresponsibility in the business activity when the coverage of social insurance is growing; onthe other hand, the more progress we make, the more cases of the right to social security riseup. Since the2007Party Congress commented "to speed up the establishment of a socialsecurity system covering both urban and rural residents", national labor dispute mediation andarbitration agency received500000cases, compared with2013, national labor disputemediation organizations cases of disputes over the right to accept social security numberreached1403000, up180%. In the face of the increasing demands of judicial remedy of theright to social security, the government should improve the ability when dealing with thesecases.In order to solve these problems, this article discusses the concept of the right to socialsecurity and admits the value of social security system, analyzing the statistics of the judicialdata, concluds the problems and their causes. In the theoretical discussion, this article uses theexperiences from the developed countries and regions for reference, proposing the suggestionto make Chinese judicial remedy system perfect.
