Research On The Public Officials’ Privacy

With the continuous development of the economy and society, the public officials’privacy constantly conflicts with citizens’ right to know, freedom of the press andfreedom of speech. Citizens’ right of democratic supervision lacks effective guaranteewhile the public officials’ privacy is overlimited and public power abused. Based uponcitizens’ basic rights, the article will further discuss the restriction and protection of thepublic officials’ privacy, analyzing the boundaries of the public officials’ privacylimitation and exploring some specific approaches to resolving the conflict between thepublic officials’ privacy and other related rights to protect human dignity.The thesis is mainly divided into three parts: the introduction, the main text and theconclusion. The main text includes the following parts:The first part mainly analyzes the composition and characteristics of the publicofficials’ privacy and leads to the particularity of it. That is likewise why the publicofficials are taken as the special subject of privacy right separately. The second partmainly analyzes the current situation and the basis of the restrictions in public officials’privacy and then put forward the basic principles to restrict the public officials’ privacy.The third part analyzes the present situation and essence of the public officials’ privacyprotection. In order to prevent the public officials’ privacy from excessive restrictionsand protect the basic dignity of a person, the paper presents a key layer and a peripherallayer for the public officials’ privacy from “Essential content security” theory. Thefourth part tries to coordinate the conflict between the public officials’ privacy and otherrelated rights through the previous theoretical analysis, which can not only safeguardcitizen effective supervision but protect the public officials’ privacy reasonably. Themain purpose of this paper is to realize right restriction and human right protection.
