The Discussion And Practice Of The Compensation Legal System For Metro Passengers’ Personal Injury

With the constant development of rail transit in our country, both the operating lines andoperational mileage are increasing. The probability of accidents also increasescorrespondingly. For instance, cases of metro passengers’ personal injury over the years riseprogressively. The metro operation enterprises invested lots of manpower, material resourcesand energy in dealing with the passenger personal injury disputes. Therefore, it is very urgentto conduct the study of metro passengers’ personal damage compensation legal system that isthe proper settlement to the disputes. This thesis attempts to analyze the situation and thetrend of the compensation for damage. It concludes with suggestions for the contemporarycompensation legal system of metro passengers’ personal injury.This research uses value analysis, empirical analysis and comparative analysis. This articleanalyzes present situation and legal principle of metro passengers’ damage, investigatesTaiwan metro legislative practice, and then proposes how to improve the legal system ofmetro passengers’ personal injury.This thesis mainly consists of four parts.Part I is the status analysis of metro passengers’personal injury nowadays in China. Part II introduces the legal principle of metropassengers’ damage compensation. Part III elaborates on the liability for damage of themetro operation enterprises. Part IV concludes and reflects on the vision of the compensationlegal system of metro passengers’ personal injury of our country.
