Research On Marital Duty Of Loyalty

For the couples’ duty of loyalty, there have been new developments; This articlebased on the existing legal norms, interpreted of the duty of loyalty couple with newinsights into the problems.This paper is divided into five parts.The first part is an introduction, which described the significance of marital dutyof loyalty, researched methods, difficulties and innovation, and also introduced thedivision of marital duty of loyalty.The second part is about the statutory duty of loyalty couple, which introducedthe concept of legal marital duty of loyalty, the academic point of view this concept,especially by comparison with the personal rights and obligations faithful spouses,soused the right and moral obligation to analyze the couple faithful nature of theobligation, and finally discussed the meaning of marital fidelity academia andobligations of the law.The third part introduced the duty of loyalty which the couple agreed that thecouple faithful protocol agreements, including the agreement on the concept ofmarital fidelity, form, validity, nature and content analysis, the loyalty of themarriage is different mainly because of the nature of the agreement signed time there,marital fidelity agreements which relating to personal relationships should not violatethe terms of the law society and morals, and introduced the scope of the propertywhich should also be limited.The fourth part introduced the couple in violation of the agreement resultingfrom the faithful, in the affirmative responsibility to offset the premise, it’s also setcertain restrictions, namely the subjective malicious and deliberate retaliation breachof couples loyal duty should not be allowed to offset his proposed request. When thecouple faithful breach of statutory duty appeared, the consequences of divorcedamages will be produced, and this article also discussed the problem of the contractobligations whether can afford divorce damages.The fifth part introduced the obligation of the loyal duty between husband andwife which should be improved in the field of marital problems and suggestions.
