Analysis On Sentencing Normalization Reform

Our sentencing normalization reform is an effective, pragmatic reform. It is notonly the inheritance and development of traditional trial practice and theory, but also avariety of methods and practices that overcome the limitations.Sentencing normalization reform focuses on both substantive rules andprocedural aspects: It focuses on the combination of the introduction of quantitativemethods and the qualitative analysis and the establishment of appropriate sentencingprocedures to ensure the realization of a fair and public sentencing. Meanwhile, itlearns a lot from sophisticated research achievements from both home and abroad. Itimproves its existing problems and it aims at gradually forming sentencingnormalization reform with Chinese characteristics.This paper properly interprets the relevant concepts of sentencing normalizationreform so that readers can have a better and deeper understanding of it. Through theelaboration of contrast of the sentencing process before and after the reform, ithighlights the necessity of the reform and the following outcome; By comparing thevarious theoretical methods from both home and abroad, it comes up countermeasuresanalysis for the problems that arose in practice and it combines theory with practice tofind a more suitable way of sentencing normalization reform; It sketches out thefuture prospects of sentencing normalization reform through the exploration ofsubstantive norms and procedures.The innovation point of this paper is that the results of previous studies generallyfocus on one side to analyze, it’s not comprehensive. The author is concentrating inthe horizontal contrast between various theoretical approaches and practicalexperience on the basis of longitudinal analysis of the advantages and disadvantagesof each system and method and try to develop the most suitable path for thedevelopment of sentencing normalization reform.
