Global economic integration has brought the growth of economic but also bringing theincreasing fierce competition in world trade. Under the law of international increasing the useof non-traditional marks, scent marks, sound marks, trademarks and other unconventionalthree-dimensional trademark, It has becoming an important issue of national IP research.Healthy competition in the industry is inseparable from the convoy legal system, China’strademark odor and no clear legal provisions related theoretical studies haven’t form aconclusion, while exploring odor trademark protection in developed countries has beengradually forward and get an advanced practical experience. In recent years, China’sconsumer market, the scent marks have increased year by year, the smell of trademarkprotection issues will arise to the legal level, It is very important for maintain healthy marketdevelopment of China’s economy. This article mainly from the five parts to smell trademarkwere discussed.The first part is introduction, analysis odor trademark protection research background,significance, current research, research ideas and method to providing convenience for thefollowing studies.The second part of the paper defines the concept of scent marks, scent marks describesthe characteristics and types of scent marks function analysis and analysis of practicalsignificance in two ways to protect the odor marks.The third part comprehensive analysis of the status quo scent of trademark protection,citing the relevant international legal regime for the scent marks, international treaties and theworld trademark law protection of the region. In order to demonstrate the feasibility of odorclassification protected trademark.
