| Legal interpretation methods of the criminal judicial decision are presented in the form ofjudicial judgment. In the trial process, judges need to employ the methods and skills todetermine the meaning of applicable law provision. Legal interpretation methods whichjudges apply have the following deficiencies: the application rules of legal interpretationmethods is not unified, so is the application scale of interpretation method and the argumentof legal interpretation methods is not strong. As a result, the application of legalinterpretation methods should be improved: determine the application rules of legalinterpretation methods and combine the application of rules, the supreme court should set upbinding case guidance system to guide the judicial practice, improve judges the capability ofapplying legal interpretation methods and strengthen the argument of legal interpretationmethods in criminal judicial decisions. |
