“Self-responibility”,which is on the basis of “determination by oneself”, is oneobjective fundamental principle of criminal liability. As a justification beyond thelegislation, the self-responibility’s function of justification has become the commonview in the academic of the criminal law. To set up the self-responsibility, thevictim must have the proper responsibility ability, objection and time. The object ofself responsibility is only the victim’s legal interest.In this paper, in addition to the introduction, it has three chapters. The maincontents of each chapter are summarized as follows:The first chapter is a victim’s self-responibility and the issues related to criminallaw. This chapter has three sections. The first section introduces a victim’sself-responsibility theory. The second section describes the theoretical basis ofvictim’s self-responsibility. The third section presents the victim’s self-responsibilityand approximation theory of the similarities and differences.The second chapter is the victim’s elf-responsibility application in the fraud.This chapter consists of three parts. The first part is the constitution of selfresponsibility in crime of fraud. The second part introduces the legal effect of selfresponsibility in crime of fraud. The third part describes the excluded in the victimsof fraud in the self responsibility theoryThe third chapter is the victim of self-responsibility in fraud trap. This chapterconsists of three parts. The first part discusses the representation of victim self-responsibility in fraud trap. The second part describes the effect of self responsibilityto the victim behavior in fraud trap. The third part is the accomplished offense and theattempted crime of fraud in fraud from the victim’s self-responsibility.
