Since China’s reform and opening up, the prostitution come to re-emergence.Recently, many brothel frequenter were not satisfied to whore female sex workers,they even whore ignorant juveniles frequently. In order to show that the state’sdetermination of punishing such acts and to reflect the special protection of younggirls, the crime of whoring a girl under the age of14was settled in1997CriminalLaw Amendment, such acts were no longer punished for rape. However, since thecrime of whoring a girl under the age of14was settled, its effect is not ideal.Theorists continue to question the necessity and rationality of its existence.Justicesystem has many confusion about it. Therefore, it is necessary to study whether weshould abolish this crime or not.This paper is divided into three parts:The first part is to investigate the laws of other countries and regions whichsimilar to ours. Then to summarize the difference between the samples.The second part is to introduce the basic viewpoints of repealing supporters andkeeping supporters. And then analyze their defects.The third part is the summary paragraph. First of all, through roundly analyze thepros and cons of reservation，found it has significant drawbacks. So we should abolishthe crime of whoring a girl under the age of14. Secondly, introduce the case ofshanghai girls which involved with compensated dating. Then combined with China’sactual situation and the practices of other countries and regions, make a legislativeproposal about to add a crime which named “The crime of have sex trade withjuveniles”. Finally, transcend the single perspective of criminal law, from the aspect ofsociology to discuss how can the family, school and the society do more to protect thejuveniles’ sexual rights.
