Duty crime is very harmful, it disrupts the development of the society andeconomy, it also disrupts the social management order, and endangers the stable ofthe state power, so the party and the state has always attached great importance to theduty crime prevention and the strike. Procuratorial authority as the main body ofChina’s duty crime investigation, through the exercise of duty crimes indictment,collecting and using evidence to solve the case to control and prevent the duty crime.Collection and use of the evidence is the key to the duty crime detection, and relatesto the efficiency of the procuratorial authority to prevent and combat the duty crime.This paper is emphasis on the research of the collection and use of evidence when theprocuratorial authority investigate the duty crime. Starting from the related conceptsof duty crime evidence, the writer follows the procuratorial authority to handleevidence of duty crime activity process, namely, analyze and judge the case accordingto the clues to collect evidence, checked the qualification of collecting evidence, usethe qualified evidence to affirm the facts of the duty crime cases, research theevidence issues which may exists in each stage. Discuss the causes, and try to putforward the corresponding countermeasures to improve the efficiency of the dutycrime evidence collection and use, and to realize the prevention function ofprocuratorial authority against duty crime, safeguard social fairness and justice.Besides the introduction and the thank you part, this paper consists of three parts:The first part mainly introduce the overview of duty crime evidence, includingthe concept and characteristics of duty crime, the characteristics of duty crimeevidence, as the foundation of the duty crime evidence collection and use.The second part mainly aimed at the problems in evidence collection of dutycrime, including the steps and contents of the duty crime evidence gathering; the ideasand methods of evidence collection; the clues problems in evidence collection, andhow to build efficient clues collection system; the use of the technical investigation induty crime evidence collecting; and the human rights protection in criminal evidencecollection.The third part mainly discuss around the problems that exist in the use of dutycrime evidence, through the concept of duty crime evidence application, by reviewingthe duty crime evidence and the concrete application of evidence of duty crime, finally to the improvement of efficiency on the application of duty crime evidence,including solve difficulties in witnesses testify in order to improve efficiency use ofthe oral evidence; Preliminary investigation work for material and disciplineinspection authority to material evidence of qualification.
