A land utilization system advancing with the time and meeting the current developmentof productive forces would directly connect with the future trend of China’s economic andsocial development. the process of agricultural modernization of China is ever-acceleratingcurrently, the traditional method of scattered manpower cultivation cannot match thedevelopment of agriculture any more, therefore, How to solve the land piecemeal problemsand other relevant issues resulting from the implementation of " the two-tier managementsystem based on Household contract and combines unified and separate", in order toachieving land appropriate scale of operation and to boosting the development of theagricultural modernization, all of those are important issues to improve the rural land-usesystems.The essay consists of four parts in addition to the Introduction and conclusion.Part Ⅰ, Questions emerged: the problems of the rural contracted land managementsystem is confront with. This section is analyzed a series of problems that the rural contractedland management system is facing to in the new circumstance by recognized its greatachievement during the implementation process of the rural contracted land managementsystem.These problems are mainly constitutes of:The fragmentation of rural land isincompatible with the agricultural modernization; the conflict between the concepts ofefficiency and equity of the rural land contracted system; the decline of the effect of ruralcollective economic organizations; the conflict of affordable nature and real right nature thatcultivated in the rural land contractual management right.Part Ⅱ, The rural land reform of contract and management rights: an beneficialexploration to completing the system of rural land-use. The background and evolution processof rural land contracted management system has been introduced firstly in this section, anddemonstrated the positive effects that the rural land contracted management system hadunleased during the process of the improvement of the system of rural land-use on the basis ofthe empirical Analysis of the reform in some areas. The important function of theimplementation of rural land reform has been proposed in this section which was relevant tothe scale operation of rural farmland, the double value goals about equity and efficiency,the perfection of the rural land market mechanism of China, the way of realizing the public landownership and to promoting the transform of the peasants’ production method along with theirlifestyle, and other issue which is related.Part Ⅲ,Current situation of rural contracted land stock system-legal obstacles must bebroken. Based on the situation of rural contracted land stock system reform in the past years,combined with relevant regulations and policies, this part revealed the legal obstacles thatrural contracted land stock system is facing.Such obstacles including: the rural livelihoodsecurity function of rural contracted land stock system, restricted shareholders; thequalification of principle status of farm land management faced difficulties due to absence ofspecific regulations; for companies established by the rural contracted land stock system, therestriction to the number of shareholders constituted the hindrances of rural contracted landstock system reform; there is conflict between unlimited operation period of farm landmanagement and limited operation period of contracted land right; the expression mechanismof rural citizen’s wishes is obstructing in farm land management; it is a confused issue thatwhether collective members in rural contracted land stock system can withdraw shareholders.Part Ⅳ, Implementation of rural contracted land stock system reform-foothold andsystem design. In this part, the author considered that rural contracted land stock systemreform cannot break through the rural two-layer operative system in the rural basic operativesystem, it cannot shatter the rural collective land ownership system, it cannot violate land usecontrol. Based on the conditions stated above, the system design will carry out by focusing onthe legal obstacles the rural contracted land stock system is facing.
