The Source Of Personality

To find the source of personality rights, this article make comparison between theconstitutional right of personality and the civil right of personality，and study at therelationship between them.As we all know that it’s the Civil law began to protect personality from been hurt, andit’s the constitution made the theory of personality grew stronger. This article have analyzedthe difference between the personality and personality rights, introduced the development ofthe personality rights in history, and studied at the mutual transformation trajectory betweenthe constitutional right of personality and the civil right of personality. On the one hand that itconcluded that the Constitution is the senior value and can guide the Civil law in civil life, onthe other hand only after the senior value in Constitution transfer into the civil law can protectpersonality rights.
