The trend of patent application and licensing has already been fierce sinceawareness of patent protection in enterprises foreign and domestic escalated.Consequently, patent litigation is also becoming drastic. On the one hand, the numberof patent litigation is increasing by the result that implementation and promotionstrategies of Chinese intellectual property. On the other, foreign enterprises areblocking domestic enterprises by patent litigation which is inevitable in globalization.Patent management should be taken into account to avoid these unnecessary issuesand to provide solution when patent litigation happened.This paper has four chapters.Chapter1tries to illustrate current domestic patent litigation situation bystatistics analysis and cases study. Unoptimistic conclusion, when it comes to foreignpatent litigation, is drawn.Chapter2tries to prioritize the key factor in foreign patent litigation. To bespecific, this chapter will put the intro and the content of patent management forward.Then two respects, prevention and enhancement, will be depicted in sustaining patentlitigation.Chapter3tries to recount HP vs Acer. Comparing patent distribution betweenHP and Acer, this chapter will highlights Acer’s perfect strategy towards HP’slawsuits.Chapter4tries to propose some strategies on patent litigation in patentmanagement’s angle. This chapter will firstly explain the reason why Chineseenterprise is incapable in patent litigation and put solutions to change these inabilities.These solutions are included upgrading patent management and perfecting respondentstrategy.
