Study On Industry Association’s Supervision Legal Mechanism Of Food Safety In China

Food safety is the foundation of people’s health and life. But in recent years, the frequentoutbreak of food safety problem shakes even destroys consumers’ confidence in thesupervision system of food safety and arouses consumers’ panic at one time. For solving thisimminent problem, the central and local governments formulate lots of law and policies, themost noticeable is the formulation and implementation of Food Safety Law. However, FoodSafety Law doesn’t improve the security level of food safety. Partly because the mediaincreases its focus periodically, the main reason is that the current measures can’t functionenough. The fact of food safety problem tells us that we must come out a solution to settle thisserious problem. To prevent and control food safety risk more efficiently, the paper basing onour current model of food safety supervision mechanism and the legitimacy and advantage ofFood Industry Association, utilizes public administration, public policy, literature referencelaw, empirical study and the comparative analysis method to discuss how to improve theefficiency of Food Industry Association supervision legal mechanism of food safety.Except the introduction, this paper includes four parts.The first part is about Food safety supervision mechanism in our country. By introducingthe food safety supervision mechanism which including administrative supervision and theeffect of other subjects, it discusses the reasons that why the subjects can not supervise foodsafety efficiently.The second part is on the legitimacy and advantage of Food Industry Association. In thefirst place, it draws the conclusion of the evidence of its legitimacy and rationality byanalyzing the reasons why Food Industry Association can supervise food safety. Then itexplores the advantages of Food Industry Association in comparison with other subjects’supervision. That’s the reason for which the writer chooses to improve the effect of currentmodel of food safety supervision from Food Industry Association.The third part is on the operating mechanism of Food Industry Association and the obstacles which block the playing of Food Industry Association. It analyzes the autonomousmechanism, the self-discipline mechanism, the service mechanism and the reward andpunishment mechanism to make the supervision mechanism of Food Industry Associationclear and distinct. On the basis, it expounds the obstacles that block Food IndustryAssociation bringing its supervision into play. Meanwhile it lays foundation for the forth part.The forth part is on the suggestions to perfect the food safety supervision mechanism ofFood Industry Association.
