With the rapid development of Chinese economy, the environmental pollution event entered the high-fat period, caused by environmental pollution disputes are increasing. But, in contrast with the reality is, the more disputes, litigation but rarely caused by environmental pollution, environmental protection and lawyers involved in the case is less. What is the reason? Facing the problems, we think, what lawyers to participate in environmental protection dilemma, way out and where.To understand the present situation, is the foundation to solve the dilemma. In this paper, the author analyzes the present situation of lawyers involved in the environmental pollution case, using the three methods of studing the text, questionnaires, research concil. The present situation of China, pollution of the environment is not optimistic,ration of lawyers involved in the case is low. China’s environmental legal system is not perfect, the lack of environmental activist legal occupation community and human rights lawyers working mechanism is not reasonable, environmental public interest litigation system deficiencies, and imbalance of the party’position, is China’s lawyers involved in four major difficulties facing the environmental rights. The four big dilemma, is the cause of the environmental disputes, litigation for less, the fundamental reason lawyers to participate in environmental protection is less this phenomenon appears. To understand the present situation, in the face of difficulties, to find a way out. In a way, I think, we can find the law of environmental protection in the four aspects:the way lawyers should actively participate in the legislative activities, improve the environmental legal system of our country; lawyers should be well versed in environmental protection strategy, to ensure the correct implementation of the law; legal advisor to the government, enterprises should actively prevent environmental legal risks; continuously improve the environmental quality of their own human rights lawyers, strengthen the construction of human rights lawyers professional team.In China, environmental protection is also facing environmental law and public law system reconstruction problem. Environmental public interest litigation, from the "revised civil procedure law", the legal system of public interest litigation in our country is still at an initial stage, a system from the generation, to accept, to development, to mature, not a short duration of time.
