The Analysis Of Leniency Policy In Chinese Anti-monopoly Law

Our country established the leniency policy in the anti-monopoly law in2007.However, the law is too simple, the relevant rules, and the implementation procedures arealso thin. Based on the basic theory of the leniency policy, the article introduces andcompares the policy in the United States, the European Union and Japan. And through theintroduction to the present situation of the leniency policy in our country, summarizes theissues such as the the application process is not complete, the provisions about theresponsibility are too broad, and the enforcement agencies is sparse. To solve theseproblems, this article argues that should expand the scope of leniency policy, to ensurethat the associations and the person can also apply to the policy; Complete the applicationprogram of leniency policy in the details; Improve the related criminal and civil liability;Specialism the enforcement agencies.
