The tendency of turning criminal law into criminal policy means to emphasize the reaction between the criminal policy and the criminal law system. Rather than considering the criminal policy as a theory, it is better to be thought as a process that every country is experiencing on common in the aspect of reality.The core of this proposition is dealing with the relationship between the criminal policy and the criminal law system correctly. The development history of German criminal law provides two ways for us to choose. There are the separate way of Liszt and the one type way of Roxon. The one type way shows us the huge potential with practice experience. In the context of globalization, the life style of people is high convergence, and the social contradictions are similar in different countries. The China is still in the before age of the legal era, we have no opportunity back to the era origin of Liszt again for a long evolution. Only based on the present and absorbing the development efforts from the German criminal law on a across in one hundred years. The aim of this article is to understand and analyze the purposive rationality of the criminal system, combining with the native resources to reform, and finally find out a suitable path for China’s criminal law into criminal policy.
