An Empirical Study Of The Mechanism About Chinese Grassroots Civil Prosecution

Civil procuratorial supervision means that the Chinese procuratorial organs exercise theirsupervision over civil proceeding.Exercising procuratorial authority according to law is one ofthe important legal supervision responsibilities of procuratorial organs.As an important part ofprocuratorial system, civil procuratorial supervision is in the strengthening,reform andtransition period of the development of socialism with Chinese characteristics.Theprocuratorial organs performing their responsibilities in accordance with law, matters towhether can we always adhere to the socialism procuratorial system with Chinesecharacteristics and whether can we emancipate the mind,seek truth from the facts,safeguardjudicial justice and explore the truth,and even to the further development of the futureprocuratorial work.One2009-2013survey on civil procuratorial work in Linyi city, Shandongprovince,however,found that now the legal literacy of civil litigants in domestic lawsuits ispoor, biases about the procuratorial work is preserved in the court,at the same time theprocuratorial organs’ self-development is inadequate,all that combined,bringing about thepresent China grass-roots civil procuratorial supervision system crisis.How to resolve thecrisis,improve the civil procuratorial supervision system, in order to bring its fairness andauthority of justice into full play.These are the problems that the author will explore in thepaper.The paper mainly divides into four parts:The first part is to analyze and demonstrate theelementary theory of the civil procuratorial supervision system and make an introduction ofthe nature of the civil procuratorial supervision system in our country and the rationality ofexistence at the present stage. The second part is mainly to introduced the development history of the civil procuratorial supervision system and the current laws and regulations，and point out the shortage of the current law from the Angle of system operation。The thirdpart is to analyze the present situation of the civil procuratorial supervision work,making aconcrete analysis of the present problems on the basis of the2009-2013survey. The forth partthe author will probe the improvement of the system，listing the measures in the followingaspects: perfecting corresponding laws,changing work concept and pattern,enhancingcommunication with the court,increasing the visibility of the procuratorial organs to the publicand the author will also propose suggestions directly to the gross-roots civil procuratorialsupervision on how to shift from the protest center model to the multi-models and how toperfect the way of civil procuratorial supervision.
