Legal Issues Of The Judicial Expert On Intellectual Property

In the case of intellectual property, the judicial expert on Intellectual property implements appraisal and gives the expert opinion. So, ability, knowledge, experience of the judicial expert decides the judgment of the case. However, operation status of judicial expert on intellectual property system is not optimistic. If we can not improve it, it will hinder the development of the intellectual property system in forensic. In this paper, I described the basic theory of the judicial expert on Intellectual property, and analyzed the problems in running of the judicial expert on Intellectual property, then contrasted the foreign forensic expert system and china forensic expert system on intellectual property, finally, I gave my suggestions to improve China’s judicial expert system on Intellectual property.This article consists of three parts,an preface, body and conclusion, then the body is divided into three chapters.The first chapter introduced the fundamental theory of intellectual property. In this chapter, I defined the concept and effect of the judicial expert on Intellectual property.The second chapter analyzed the problems of forensic expert system on Intellectual property. In this chapter, I analyzed the problems in qualification, attendance, liability and judicial protection of the judicial expert on Intellectual property. The third chapter gave the suggestions for China’s judicial expert system on Intellectual property. In this chapter, I analyzed the relevant provisions of the common law and civil law countries, then made recommendations to improve several aspects of judicial expert on intellectual property, including qualifications,attendance, liability and judicial protection of the judicial expert on Intellectual property...
