Intellectual property law in China as a transplanted legal system, it is lack of survival soil in our country, the completely exotic production is established in our country to adapt to the social development and the international trend. Intellectualproperty Institutional practice in China has three decades of history, although the system we have is high level in the world, but the protection of intellectual property rights in China is still criticized by all countries in the world, although our system construction foothold station is high enough, but it’s still unable to walk out of legal transplantation that brings "rejection" phenomenon of the circle.One country to the effective operation of the intellectual property system is based on the premise and the corresponding intellectual culture.
