Among them, newproblems most of the time will cause unease among us, as we have been used to theunfitness between the latest problems and the making of relative laws. Of the increasingcases of trademark infringement caused by the network link, it has become awidely-concerned issue in judicial practice as to how to define their legitimacy, as well aslegal responsibilities caused by torts.Through analyzing current circumstances of trademark on the Internet. In themeantime, foundational theories of the network link and the existing trademark laws, otherlegislation concerned home and abroad will also be referred to. Through this systematicstudy on possible trademark torts, this paper is aimed to put forward my views as well assuggestions on clear confirmation and evaluation of legal responsibilities. In a word, weshould protect legal rights of trademark owners while encouraging the development of thenetwork link technologies, achieving the balance between both rights and obligations, aswell as the greatest profits of both.
