On Criminal Regulation Of Child Abuse

In recent years, serious cases of child abuse occur frequently in our country, the behavior of child abuse can not forbid by law. The phenomenon has caused very bad social impact, at the same time, the public and scholars pay more and more attention on this problem of child abuse, they always appeal to use the law to deal with the cases of child abuse seriously. However, due to the existing provisions of the law on the protection of children is still not prefect, the relevant offices are not able to solve the problem of child abuse very well. Especially at the level of the criminal law, many serious behaviors of child abuse which impact our society can not be evaluated correctly in life. Therefore, it is necessary and right to investigate how to use the criminal law to solve child abuse problem.This paper defines the behavior of child abuse by anglicizing behavior at first, and the characteristics of the behavior has discussed. Then the necessity and feasibility of improving the criminal law on child abuse has disserted in the text. By judging whether the behavior is independent criminal behavior or not in criminal law, clarifying my view of supporting for establishing of the crime of child abuse, and selecting legislative mode. Afterward putting forward some suggests on establishment of a new offense from In terms of crime of child abuse. In addition, penalties set of new charges and prosecution mode have conceived. Creating the crime of child abuse try to reach the target of deal with the child abuse problem by criminal law, establishing the double protection on children’s physical and mental health, promoting social development harmony and stably.
