Network Copyright Indirect Infringement

Today,we are in an era of Internet developing highly.in such an era,more products be on the network in various of forms.Internet is so quick,wide range and different,leading to a growing number of copyright infringement cases occurred on the Internet,and the indirect infringement is the focus of discussion on the network infringement in recent years.The indirect infringement under the network environment is more subtle complex than traditional environment.Especially for Internet Service Provider,can’t simply apply the principle of imputation of traditional copyright law to determine its responsibility.The author thinks that,for the cognizance of the indirect infringement liability under the network environment should be to promote the prosperity and development of the society as the final purpose.For Internet Service Provider,shall bear tort liability,should not only consider the position of strength,as economic organizations and technology owner gives its certain obligations and responsibilities,also should fully realize the Internet-Service-Provider’s service function and the important role of society.Compared with traditional copyright infringement on paper,indirect infringement on the Internet is more subtle and complex.Traditional copyright law and the tort liability law on Internet copyright indirect infringement responsibility has showed shortages.Our country has also been aware of the problem,in the relevant laws,some rules have been written,but there rules is disrupt.There are five sections in this article.The first part is the basic situation of the indirect copyright infringement,the author introduces the concept,characteristics and types of indirect copyright infringement,preliminary understanding what is the difference between the indirect copyright infringement and the direct infringement.The second part the author introduces what is the network copyright indirect infringement.The third part the author expounds the main problem of network copyright infringement liability,including its concept,classification,the basis and source.The fourth part is the network copyright indirect infringement liability legislation in other countries.In the fifth part,the author introduces the law about the network copyright indirect infringement in China and puts forward the legislative suggestions.
